GENERAL TERMS OF USE

These General Terms of Use (GTU) and the Privacy Policy constitute your contract with Interchim®. By using the “TLC to Flash and Prep Chromatography” app published by Interchim®, you are agreeing that you are bound by the current GTU and the Privacy Policy.

Article 1. Definitions

“User”: any natural person over the age of 18 who uses the app issued by Interchim®.

“Content”: means the brands, drawings, texts, logo, graphic works, photographs, videos, software applications belonging to the company Interchim®.

“Service”: means the app "TLC to Flash and Prep Chromatography" published by the company Interchim®

Article 2. Description of the "TLC to Flash and Prep Chromatography" issued by Interchim®

The aim of “TLC to Flash and Prep Chromatography” is to facilitate the work of scientists in their development of the TLC plate as well as in the preparation of the purification and separation method.

Article 3. Accepting the conditions

In order to use the Service, the conditions must first be accepted. In the event that they are not accepted, it will not be possible to use the Service.

By using the Service you accept these conditions. As of its use, you acknowledge and agree that Interchim® may consider your use of the Service as an acceptance of its terms and conditions.

Neither the Service may be used nor the terms accepted if a) you have not yet attained the legal age of majority to enter into a contract with Interchim®; or (b) if the laws of the country you reside in, or the country from which you access or route, prohibit you from receiving or using the Service.

Article 4. Obligations of the User

The User undertakes to use the Interchim® app in accordance with the current GTU and applicable laws.

In particular, the User undertakes not to carry out the following actions:

• Modify, copy, distribute, transmit, reproduce works belonging to Interchim® or create derivative works;
• Reproduce or utilise Content without the prior and express permission of Interchim®;
• Attempt to modify, adapt, revise or decompile any software programs belonging to Interchim® without the express and prior consent of Interchim®.

Any reproduction or utilisation of Content not authorised by Interchim® constitutes a violation of intellectual property in accordance with the provisions of the Intellectual Property Code. The User acknowledges that he is responsible for misjudgement of these provisions under civil and criminal law.

Article 5. Limitation of liability

Interchim® cannot be held liable for errors, approximations or omissions in the results of the measurement processes conducted by the User. In fact, the User acknowledges that any scientific measurement process is susceptible to proneness of error and that he is required to carry out the measurements with the utmost care and all due diligence.

Interchim® can by no means be held responsible for any indirect damage, specific, illustrative incidents suffered by the User, and in particular, but not limited to: loss of income, exchange rate loss, loss of profits, commercial loss, loss of revenue, or other financial loss.

If and when the functioning of the Interchim® app is dependent on third-party companies (but not limited to: Google and Apple), Interchim® cannot be held liable for any interference/malfunction of the app - and in particular, but not limited - due to changes in the Services of such third-party companies, interruptions of Services, refusal of permission, validity periods of these third-party companies, on which Interchim® has absolutely no influence.

Article 6. Law and competent jurisdiction

The current GTU are subject to French law. Any dispute or difficulty in the interpretation of this GTU is subject to the jurisdiction of the Montluçon Commercial Court.

PRIVACY POLICY

Interchim® certifies and warrants that the purpose of the app is exclusively to facilitate the thin layer chromatography as well as the transmission of the obtained results to the puriFlash® purification systems and not to identify Users.

Interchim® does not collect data and has no access to data through the use of the app. Consequently, Interchim® cannot access the results obtained by the User, which are confidential.

The use of the app does not require the setting up of an account by the User nor the collection of personal data. For the purposes of amended Law No. 78-17 of January 6, 1978, personal data is understood to mean any information about an identified or identifiable person, directly or indirectly, by reference to an identification number or one or more particulars specific to it.

Interchim® does not collect any personal data on this app. If the User has the possibility to send the results to his e-mail address, this is conducted locally (via WLAN or Bluetooth). Neither the User’s e-mail address nor the associated data are stored on the server. The same applies to the transmission of data via WLAN or Bluetooth of the app to the purification system, which takes place locally.

第 1 条: 定义

“用户”: 任何年满18岁的自然人使用Interchim®发布的应用程序.

“内容”: 指属Interchim®公司的商标, 图形, 文章, 徽标, 图形作品, 照片, 视频, 软件应用程序等.

“服务”: 指由Interchim®公司发布的 « 薄层色谱到快速纯化和制备纯化色谱 » 应用程序.

第2条 : Interchim® « 薄层色谱到快速纯化和制备纯化色谱 » 应用程序的描述

« 薄层色谱到快速纯化和制备纯化色谱 »旨在协助科学家发展薄层色谱以及准备纯化和分离方法.

第3条 : 接受条款

为了使用此服务, 您必须先接受相关条款. 如不接受条款, 则无法使用此服务.

通过使用此服务, 您即表示接受这些条款. 从使用开始, 您承认并同意Interchim®可以将您使用该服务视为对其条款的接受.

若(a) 您未满法定年龄, 无法与Interchim®签订合同, 或(b) 您所在国或访问/途经所在国家的法律禁止您接收或使用该服务, 则不得使用该服务.

第4条 : 用户义务

用户承诺遵守当前的使用条款及适用法律使用Interchim®应用程序.

特别是, 用户承诺不进行以下行为：

• 修改、复制、分发、传输、复制属于Interchim®的作品或创作衍生作品 ;
• 在未经Interchim®事先明确许可的情况下复制或使用内容；
• 未经Interchim®明确同意，尝试修改、适配、修订或反编译属于Interchim®的任何软件程序.

任何未经 Interchim® 授权的复制或使用内容都构成侵犯知识产权, 依据《知识产权法典》条款, 用户承认其在民事和刑事法律上的责任.

第5条 : 责任限制

Interchim® 不对用户测量过程中的错误, 近似或遗漏承担责任. 用户承认, 任何科学测量过程都可能存在误差, 且用户应在进行测量时保持最大程度的谨慎和尽职使用.

Interchim® 不对用户遭受的任何间接损失, 特殊或示例性事件负责, 包括但不限于：收入损失, 汇率损失, 利润损失, 商业损失, 收入损失或其他财务损失.

如果Interchim® 应用程序的功能依赖于第三方公司（包括但不限于, 如Google和Apple等）, Interchim® 不对应用程序的干扰或故障承担责任, 尤其是由于这些第三方公司服务的变更, 服务中断, 权限拒绝, 有效期问题等因素, 这些都不在Interchim®的控制范围内.

第6条 : 法律适用与管辖法院

本使用条款受法国法律管辖。任何关于本使用条款解释的争议或分歧，均应由法国 Montluçon商事法院管辖。

隐私政策

Interchim®保证本应用程序的唯一目的是促进薄层色谱法（TLC）以及将获得的结果传输至puriFlash® 快速纯化系统, 并非用于识别用户.

Interchim®不收集数据, 且无法通过应用程序運行用户的数据. 因此, Interchim®无法得知用户获得的结果, 这些结果是保密的.

使用该应用程序不需要用户设置帐户, 也不涉及个人数据的收集. 根据1978 年1 月 6 日修订法第78-17号法, 个人数据指的是任何关于已识别或可识别的个人信息, 通过身份识别号码或其他特定细节可以直接或间接进行识别.
